Superior Court Justice Janet Sanders today denied the defendant’s motion to dismiss in the case Carroll v. Board of State Examiners of Electricians. In this case, the Clinic is representing general contractors whose ability to continue contracting for and supervising rooftop solar photovoltaic installations has been threatened by a decision of the Massachusetts Board of State Examiners of Electricians that would give electricians a monopoly over all aspects of solar PV work. The plaintiffs are challenging the Board’s action as being inconsistent with the electrical licensing statute and a de facto regulation improperly adopted without notice and comment. The opposition to the motion to dismiss was argued by Clinic student Nicholas McDaniel (JD ’11).
